These Terms are the agreement between you and Screwcap Games, LLC (“Screwcap,” “we,” “us”) covering Gold Digger — the website, the game, the Vault Pass, and everything around them (the “Game”). By playing the Game or buying anything in it, you accept these Terms.
In plain terms: play the game, you agree to the rules. Gwen didn't write them, but she'll enforce them with the enthusiasm of a woman who counts the silverware.
Gold Digger is entertainment and education. Every price, event, “expert,” forecast, and outcome in the Game is simulated, dramatized, or delayed for teaching purposes and may bear no relation to any real market. Nothing in the Game is investment, trading, tax, legal, or financial advice, an offer, a solicitation, or a recommendation to buy, sell, or hold any asset, security, commodity, currency, or cryptocurrency.
We are not a broker, dealer, investment adviser, or fiduciary, and using the Game creates none of those relationships. Any real-world financial decision you make is yours alone — ideally taken with a licensed professional who is accountable to you, which we are not.
If you take portfolio advice from a game whose narrator openly enjoys your losses, that is a decision, and it is yours. The house teaches; the house does not underwrite your convictions.
All capital, coins, and stakes in the Game are virtual and have no monetary value. No real money is wagered, deposited, or won, and no prize of monetary value is awarded. The Vault Pass buys features, not odds.
You must be at least 13 years old, old enough to form a binding contract where you live, and — to make a purchase — of the age of majority in your jurisdiction. If you're using the Game somewhere it's not permitted, that's on you.
The Game largely runs on your device without an account. If you post to a leaderboard you choose a display handle. Don't pick something offensive, deceptive, or impersonating, and don't put personal information in it. You're responsible for activity under your device and handle, and we may remove handles or scores that break these rules or look like cheating.
Your handle is public and permanent-ish. “Please don't dox yourself in the leaderboard” should not need saying, yet here we are.
The Vault Pass and any in-game items grant you a limited, personal, non-transferable, revocable license to use certain features and content. They are notmoney, not a stored-value instrument, not securities, and they have no cash value and no value outside the Game. We may add, change, suspend, or retire features over time, including ones you've unlocked, though we won't do it capriciously.
You're buying access to the good stuff, not a deed. If a feature evolves or retires, that's the nature of a living game — not a heist.
Purchases are processed by Gumroad, which acts as the merchant of record and handles billing, payment methods, sales tax/VAT, and receipts under its own terms and privacy policy. We never see or store your full payment details. After a successful purchase you receive a license key; enter it under “Restore purchase” to unlock on any device. Refunds are covered in our Refund Policy.
If you submit a handle, score, or other content, you grant us a worldwide, royalty-free license to display and use it to operate the Game (for example, showing it on a leaderboard). Keep submissions lawful and non-infringing.
Don't cheat or manipulate the leaderboards; don't scrape, overload, or attack the Game; don't reverse-engineer it beyond what the law expressly permits; don't resell or sublicense access; and don't use the Game to break the law or infringe anyone's rights. We may suspend or terminate access for any of the above.
The Game and its code, characters (including Gwen), artwork, copy, sounds, and design are owned by Screwcap and its licensors and protected by law. Third-party names, marks, data sources, and links belong to their owners and appear for education and reference, not endorsement. We grant you a personal, non-commercial license to play — nothing more.
The Game references outside sources, data providers, books, and experts, and may include affiliate links. We don't control those sites or data and aren't responsible for them; their terms and accuracy are their own. A link is a pointer, not a promise.
The Game is provided “as is” and “as available,”without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Game will be uninterrupted, accurate, or error-free.
Translation: it's a game, it may hiccup, and the simulated market will absolutely lie to you. That's the tuition.
To the fullest extent permitted by law, Screwcap and its people will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, data, goodwill, or — and we cannot stress this enough — any trading or financial decision you make. Our total liability for any claim relating to the Game will not exceed the greater of the amount you paid us in the prior twelve months or USD $50.
You agree to defend, indemnify, and hold harmless Screwcap and its licensors and people from claims, losses, and expenses (including reasonable legal fees) arising out of your use of the Game, your breach of these Terms, your violation of any law or third-party right, or any real-world financial loss you attribute to information you saw in a game.
These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-laws rules, and any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Walworth County, Wisconsin. If any provision is held unenforceable, the rest stays in force.
We may update these Terms; material changes are reflected by the “last updated” date above. Continuing to use the Game after a change means you accept it. We won't email you a novel about it.
